 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to certain fees for collecting, disbursing, or monitoring
 1-9     spousal maintenance or child support payments in Dallas County.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 152.0633(g), Human Resources Code, is
1-12     amended to read as follows:
1-13           (g)  The department has the duties assigned by the
1-14     administrator or the local administrative judge and prescribed by
1-15     this section and Section 152.0634, including the duty to:
1-16                 (1)  collect, receive, [and] disburse, and monitor
1-17     support payments that are required by court order to be made to the
1-18     department; and
1-19                 (2)  collect, receive, and deposit the fees authorized
1-20     under Section 152.0634 or 152.0635.
1-21           SECTION 2. Section 152.0634(b), Human Resources Code, is
1-22     amended to read as follows:
1-23           (b)  The administrator shall receive and disburse the
1-24     payments in the manner the court believes to be in the best
1-25     interest of the parties involved in the case.  The administrator
1-26     shall collect a fee for receiving, [and] disbursing, or monitoring
1-27     the payments as provided by Section 152.0635.
1-28           SECTION 3. Section 152.0635(a), Human Resources Code, is
1-29     amended to read as follows:
1-30           (a)  The district and county courts administrator shall
1-31     assess and collect a monthly fee of not more than $3 for
1-32     collecting, [and] disbursing, or monitoring spousal or child
1-33     support payments.  The fee is payable annually and in advance.  The
1-34     local administrative judge shall set the amount of the fee.  The
1-35     court ordering payment shall determine if the payor or payee of the
1-36     support must pay the fee and may designate a person to collect the
1-37     fee for the administrator.
1-38           SECTION 4. The changes in law made by Sections 152.0633,
1-39     152.0634, and 152.0635, Human Resources Code, as amended by this
1-40     Act, apply only to a fee due on or after the effective date of this
1-41     Act.
1-42           SECTION 5. This Act takes effect September 1, 2001.
