                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to measuring the height and weight of public school
 1-3     students.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Chapter 38, Education Code, is amended by adding
 1-6     Section 38.013 to read as follows:
 1-7           Sec. 38.013.  STUDENT HEIGHT AND WEIGHT MEASUREMENTS. (a)  In
 1-8     conjunction with the screening under Section 36.004, Health and
 1-9     Safety Code, to detect special senses and communications disorders,
1-10     the school district a student attends shall provide for the
1-11     student's height and weight to be measured and recorded.
1-12           (b)  In meeting the requirements under Subsection (a), a
1-13     school district shall:
1-14                 (1)  consult and coordinate with the Texas Department
1-15     of Health; and
1-16                 (2)  take and record the measurements in a manner that
1-17     ensures that a student's measurements are not disclosed to another
1-18     student during that process.
1-19           (c)  To address the needs of students who are overweight and
1-20     to maintain the health of students who are not overweight, a
1-21     district may:
1-22                 (1)  adjust cafeteria menus and  the content of school
1-23     vending machines to provide more healthy, low-fat foods; and
1-24                 (2)  increase the amount of time allocated to students
 2-1     for physical activity during the school day.
 2-2           SECTION 2. Section 38.013, Education Code, as added by this
 2-3     Act, applies beginning with the 2001-2002 school year.
 2-4           SECTION 3.  This Act takes effect immediately if it receives
 2-5     a vote of two-thirds of all the members elected to each house, as
 2-6     provided by Section 39, Article III, Texas Constitution.  If this
 2-7     Act does not receive the vote necessary for immediate effect, this
 2-8     Act takes effect September 1, 2001.
