                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the form and content of notices of matters under the
 1-3     jurisdiction of the Texas Natural Resource Conservation Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter D, Chapter 5, Water Code, is amended
 1-6     by adding Section 5.127 to read as follows:
 1-7           Sec. 5.127.  SUMMARY FOR PUBLIC NOTICES. (a)  The commission
 1-8     by rule shall provide for each public notice issued or published by
 1-9     the commission or by a person under the jurisdiction of the
1-10     commission as required by law or by commission rule to include at
1-11     the beginning of the notice a succinct statement of the subject of
1-12     the notice.  The rules must provide that a summary statement must
1-13     be designed to inform the reader of the subject matter of the
1-14     notice without having to read the entire text of the notice.
1-15           (b)  The summary statement may not be grounds for challenging
1-16     the validity of the proposed action for which the notice was
1-17     published.
1-18           SECTION 2.  (a)  The commission shall adopt rules under
1-19     Section 5.127, Water Code, as added by this Act, to take effect not
1-20     later than March 1, 2002.
1-21           (b)  This Act takes effect September 1, 2001.
