No. 2654 77R8164 SGA-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to a requirement that a child-care facility or family home 1-3 complete a background and criminal history record check before 1-4 hiring a new employee. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Subchapter C, Chapter 42, Human Resources Code, is 1-7 amended by adding Section 42.0571 to read as follows: 1-8 Sec. 42.0571. BACKGROUND AND CRIMINAL HISTORY CHECK FOR NEW 1-9 EMPLOYEES. Notwithstanding any other law, the director, owner, or 1-10 operator of a child-care facility or family home may not hire a 1-11 person as an employee until the facility or home receives 1-12 background and criminal history record information relating to the 1-13 person. 1-14 SECTION 2. This Act takes effect September 1, 2001, and 1-15 applies to a person hired on or after that date. A person hired 1-16 before that date is governed by the law in effect on the date the 1-17 person was hired, and that law is continued in effect for that 1-18 purpose.
