                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the duties and powers of the Southmost Regional Water
 1-3     Authority.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Chapter 511, Acts of the 67th Legislature, Regular
 1-6     Session, 1981, is amended by adding Section 18A to read as follows:
 1-7           Sec. 18A. (a)  Subject to approval by a majority of the
 1-8     voters voting in a confirmation election held under the guidelines
 1-9     of Section 36.017, Water Code, on the proposition that the
1-10     authority should exercise the powers of a groundwater conservation
1-11     district, the authority has all of the rights, powers, privileges,
1-12     authority, functions, and duties provided by Subchapter D, Chapter
1-13     36, Water Code, within the boundaries of the authority and, except
1-14     as provided by Subsection (b), within the territory that is not
1-15     within the authority's boundaries and that is located in that
1-16     portion of Cameron County that is south of the southern
1-17     right-of-way for U.S. Highway 77/83 and Texas Highway 100, this
1-18     territory being described as follows:
1-19     beginning at the intersection of southern right-of-way for U.S.
1-20     Highway 83 and the boundary between Cameron and Hidalgo counties,
1-21     then in an easterly and southerly direction along the southern
1-22     right-of-way for U.S. Highway 83 and then U.S. Highway 77/83 to the
1-23     intersection of U.S. Highway 77/83 and Texas Highway 100, then east
1-24     following the southern right-of-way for Highway 100 to the
 2-1     intersection with the Laguna Madre, then south following the
 2-2     eastern shore of the Laguna Madre, South Bay, and the Gulf of
 2-3     Mexico to the intersection with the boundary of Cameron County,
 2-4     then following the boundary line of Cameron County along the Rio
 2-5     Grande River in a westerly and northerly direction to the Cameron
 2-6     and Hidalgo County line, thence in a northerly direction along
 2-7     county line to the point of beginning.
 2-8           (b)  The territory within the corporate limits and
 2-9     extraterritorial jurisdiction for subdivision plat approval of any
2-10     municipality that is not a member of the authority is excluded from
2-11     territory in which the authority may exercise its powers under this
2-12     section unless that territory is within the boundaries of the
2-13     authority.
2-14           SECTION 2.  (a)  This Act takes effect immediately if it
2-15     receives a vote of two-thirds of all the members elected to each
2-16     house, as provided by Section 39, Article III, Texas Constitution.
2-17     If this Act does not receive the vote necessary for immediate
2-18     effect, this Act takes effect September 1, 2001.
2-19           (b)  If the proposition submitted to the voters under Section
2-20     18A, Chapter 511, Acts of the 67th Legislature, Regular Session,
2-21     1981, as added by this Act, does not receive the approval of the
2-22     voters as provided by that section before September 1, 2002,
2-23     Section 18A, as added by this Act, expires on that date.
