                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of the Texas Department of Transportation
 1-3     to place and maintain traffic-control devices in certain
 1-4     municipalities.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 544.002, Transportation Code, is amended
 1-7     by adding Subsection (d) to read as follows:
 1-8           (d)  The department shall place and maintain traffic-control
 1-9     devices on a state highway in a municipality with a population of
1-10     less than 60,000 that has within its boundaries parts of three or
1-11     more state highways, as provided by the manual and specifications
1-12     adopted under Section 544.001, if the governing body of the
1-13     municipality:
1-14                 (1)  makes a request to the department; and
1-15                 (2)  enters into an agreement with the department under
1-16     Section 221.002.
1-17           SECTION 2.  This Act takes effect immediately if it receives
1-18     a vote of two-thirds of all the members elected to each house, as
1-19     provided by Section 39, Article III, Texas Constitution.  If this
1-20     Act does not receive the vote necessary for immediate effect, this
1-21     Act takes effect September 1, 2001.
