A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the eligibility of public schools and libraries for
1-3 certain funds.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Chapter 32, Education Code, is amended by adding
1-6 Subchapter C to read as follows:
1-7 SUBCHAPTER C. INTERNET ACCESS
1-8 Sec. 32.051. DEFINITIONS. In this subchapter:
1-9 (1) "Obscene" has the meaning assigned by Section
1-10 43.21, Penal Code.
1-11 (2) "Technology protection measure" means a technology
1-12 that blocks or filters Internet access to visual depictions that
1-13 are obscene.
1-14 Sec. 32.052. LIMITATION ON CERTAIN FUNDS. A public school
1-15 that provides a computer used to access the Internet that is not
1-16 equipped with a technology protection measure is not eligible for:
1-17 (1) a loan or grant under Subchapter C, Chapter 57,
1-18 Utilities Code; or
1-19 (2) a reduced rate under Subchapter B of Chapter 57,
1-20 Subchapter G of Chapter 58, or Subchapter D of Chapter 59,
1-21 Utilities Code.
1-22 SECTION 2. Subchapter I, Chapter 441, Government Code, is
1-23 amended by adding Section 441.1385 to read as follows:
1-24 Sec. 441.1385. LIMITATION ON CERTAIN FUNDS. (a) In this
2-1 section:
2-2 (1) "Obscene" has the meaning assigned by Section
2-3 43.21, Penal Code.
2-4 (2) "Technology protection measure" means a technology
2-5 that blocks or filters Internet access to visual depictions that
2-6 are obscene.
2-7 (b) A public library that provides a computer with Internet
2-8 access to the public is not eligible for a loan or grant under
2-9 Section 441.135 or Subchapter C of Chapter 57, Utilities Code, or a
2-10 reduced rate under Subchapter B of Chapter 57, Subchapter G of
2-11 Chapter 58, or Subchapter D of Chapter 59, Utilities Code, unless
2-12 the public library:
2-13 (1) implements a policy establishing measures to
2-14 restrict minors from gaining access to obscene material on the
2-15 Internet; or
2-16 (2) equips the computer with a technology protection
2-17 measure.
2-18 SECTION 3. This Act takes effect September 1, 2001.
