No. 2773 77R9137 MXM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the Department of Information Resources' oversight of 1-3 electronic projects. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter F, Chapter 2054, Government Code, is 1-6 amended by adding Sections 2054.1181, 2054.1182, and 2054.1183 to 1-7 read as follows: 1-8 Sec. 2054.1181. AUTHORITY TO STOP SPENDING ON INEFFECTIVE 1-9 PROJECTS. (a) A state agency may not spend appropriated funds for 1-10 an electronic government project if the department determines that 1-11 the project fails to meet expectations. In making this 1-12 determination, the department shall consult with: 1-13 (1) the Legislative Budget Board; and 1-14 (2) the budget division of the governor's office. 1-15 (b) The department shall, after consulting with the 1-16 Legislative Budget Board and the budget division of the governor's 1-17 office, establish: 1-18 (1) criteria for determining if an electronic 1-19 government project fails to meet expectations; and 1-20 (2) procedures for: 1-21 (A) negotiating with a state agency that is not 1-22 allowed to spend appropriated funds for an electronic government 1-23 project under this section; 1-24 (B) allowing a state agency to resume spending 2-1 appropriated funds for the electronic government project; and 2-2 (C) recommending options for future spending of 2-3 the appropriated funds. 2-4 Sec. 2054.1182. QUALITY ASSURANCE TEAM. The department shall 2-5 establish a quality assurance team to monitor projects over which 2-6 the department has jurisdiction. The team shall monitor all 2-7 projects to determine compliance with department standards. 2-8 Sec. 2054.1183. PROGRAM MANAGEMENT OFFICE. The department 2-9 may create a program management office to perform the department's 2-10 duties under Sections 2054.1181 and 2054.1182. 2-11 SECTION 2. This Act takes effect immediately if it receives 2-12 a vote of two-thirds of all the members elected to each house, as 2-13 provided by Section 39, Article III, Texas Constitution. If this 2-14 Act does not receive the vote necessary for immediate effect, this 2-15 Act takes effect September 1, 2001.
