                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the application of continuing education requirements to
 1-3     peace officers in certain municipalities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter H, Chapter 1701, Occupations Code, is
 1-6     amended by adding Section 1701.3515 to read as follows:
 1-7           Sec. 1701.3515.  APPLICATION OF SPECIFIC CONTINUING EDUCATION
 1-8     REQUIREMENTS TO CERTAIN MUNICIPALITIES.  (a)  Except as provided by
 1-9     this section, a specific continuing education requirement
1-10     prescribed by this subchapter or adopted by the commission under
1-11     this subchapter does not apply to a municipal agency that appoints
1-12     or employs peace officers in a municipality with a population of
1-13     500,000 or more.
1-14           (b)  Sections 1701.351 and 1701.355 apply to a peace officer
1-15     appointed or employed by the municipal agency.
1-16           (c)  The municipal agency shall ensure that:
1-17                 (1)  a continuing education program approved by the
1-18     municipal agency is available for its peace officers; and
1-19                 (2)  peace officers appointed or employed by the agency
1-20     comply with Section 1701.351.
1-21           SECTION 2.  This Act takes effect immediately if it receives
1-22     a vote of two-thirds of all the members elected to each house, as
1-23     provided by Section 39, Article III, Texas Constitution.  If this
1-24     Act does not receive the vote necessary for immediate effect, this
 2-1     Act takes effect September 1, 2001.
