No. 2782 1-2 (In the Senate - Received from the House May 7, 2001; 1-3 May 7, 2001, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 10, 2001, reported favorably by 1-5 the following vote: Yeas 5, Nays 0; May 10, 2001, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to the authority of the commissioners court of a county to 1-10 impose an application fee to be paid in connection with an 1-11 application or request for county ad valorem tax abatement. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Section 312.002, Tax Code, is amended by adding 1-14 Subsection (e) to read as follows: 1-15 (e) The guidelines and criteria adopted by the commissioners 1-16 court of a county may include a requirement that an application or 1-17 request for tax abatement submitted to the county under this 1-18 chapter must be accompanied by a reasonable application fee not to 1-19 exceed $1,000. 1-20 SECTION 2. This Act takes effect immediately if it receives 1-21 a vote of two-thirds of all the members elected to each house, as 1-22 provided by Section 39, Article III, Texas Constitution. If this 1-23 Act does not receive the vote necessary for immediate effect, this 1-24 Act takes effect September 1, 2001. 1-25 * * * * *
