                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to requiring students of institutions of higher education
 1-3     to obtain a state vehicle inspection for a vehicle for which the
 1-4     institution issues a parking or other permit.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 51.207, Education Code, is amended to read
 1-7     as follows:
 1-8           Sec. 51.207.  VEHICLE IDENTIFICATION INSIGNIA; VEHICLE
 1-9     PERMITS. (a)  Each public institution of higher education may
1-10     provide for the issuance and use of suitable vehicle identification
1-11     insignia.  The institution may bar or suspend the permit of any
1-12     vehicle from driving or parking on any institutional property for
1-13     the violation of any rule or regulation promulgated by the board as
1-14     well as for any violation of this subchapter.  Reinstatement of the
1-15     privileges may be permitted and a reasonable fee assessed.
1-16           (b)  This subsection applies to any motor vehicle, as defined
1-17     by Section 502.001, Transportation Code, including a motor vehicle
1-18     not registered in this state, other than a motor vehicle that under
1-19     Section 548.052, Transportation Code, is not subject to inspection.
1-20     An institution may not issue a permit to a student of the
1-21     institution for driving or parking a motor vehicle on institutional
1-22     property unless the vehicle displays a current and appropriate
1-23     inspection certificate issued under Chapter 548, Transportation
1-24     Code.  An institution may provide a reasonable grace period for a
 2-1     new or returning student or a student who acquires a vehicle to
 2-2     have the vehicle inspected and obtain an inspection certificate for
 2-3     the vehicle under Chapter 548, Transportation Code.
 2-4           (c)  The Department of Public Safety of the State of Texas
 2-5     shall adopt rules providing for the inspection under Chapter 548,
 2-6     Transportation Code, of motor vehicles not registered in this state
 2-7     for purposes of Subsection (b).
 2-8           SECTION 2. (a)  This Act takes effect January 1, 2002.
 2-9           (b)  Section 51.207(b), Education Code, as added by this Act,
2-10     does not affect the validity of a permit for driving or parking a
2-11     vehicle on property of an institution of higher education issued by
2-12     the institution before the effective date of this Act.
