No. 2787 in the following manner: 1-9 begining on page 1, line 45, strike everything beginning with the 1-10 word "of" and ending with the period on page 1, line 55, and insert 1-11 the following: 1-12 enrolled at the institution to park or drive a motor vehicle that 1-13 is not registered in this state on institutional property unless 1-14 the institution has provided written notice to the student 1-15 concerning requirements for vehicle emissions inspections pursuant 1-16 to Subchapter F, Chapter 548, Transportation Code. 1-17 Add the following subsection (e) at the end of SECTION 1 on page 2, 1-18 line 5: 1-19 (e) Each institution of higher education that maintains a campus 1-20 police force shall adopt procedures for enforcing State of Texas 1-21 vehicle inspection laws for vehicles parking or driving on the 1-22 campus of the institution. 1-23 A BILL TO BE ENTITLED 1-24 AN ACT 1-25 relating to requiring students of institutions of higher education 1-26 to obtain a vehicle emissions inspection for certain vehicles and 1-27 to notifying certain students of state vehicle registration and 1-28 inspection requirements. 1-29 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-30 SECTION 1. Section 51.207, Education Code, is amended to read 1-31 as follows: 1-32 Sec. 51.207. VEHICLE IDENTIFICATION INSIGNIA; VEHICLE 1-33 PERMITS. (a) Each public institution of higher education may 1-34 provide for the issuance and use of suitable vehicle identification 1-35 insignia. The institution may bar or suspend the permit of any 1-36 vehicle from driving or parking on any institutional property for 1-37 the violation of any rule or regulation promulgated by the board as 1-38 well as for any violation of this subchapter. Reinstatement of the 1-39 privileges may be permitted and a reasonable fee assessed. 1-40 (b) This subsection applies only to a public institution of 1-41 higher education campus that is located in whole or part in an area 1-42 in which a motor vehicle registered in the area is required to 1-43 undergo a vehicle emissions inspection under Subchapter F, Chapter 1-44 548, Transportation Code. The institution may not issue a permit 1-45 to a student of the institution for driving or parking a motor 1-46 vehicle that is not registered in this state on institutional 1-47 property unless the vehicle displays a current and appropriate 1-48 inspection certificate issued under Subchapter F, Chapter 548, 1-49 Transportation Code, indicating that the vehicle has passed the 1-50 required vehicle emissions inspection. An institution may provide 1-51 a reasonable grace period for a new or returning student or a 1-52 student who acquires a vehicle to comply with this subsection. 1-53 This subsection does not apply to a motor vehicle of a type that is 1-54 not covered by the vehicle emissions testing requirement applicable 1-55 to the area in which the institution campus is located. 1-56 (c) The Public Safety Commission shall adopt rules providing 1-57 for the inspection under Subchapter F, Chapter 548, Transportation 1-58 Code, of motor vehicles not registered in this state for purposes 1-59 of Subsection (b). 1-60 (d) This subsection applies only to a public institution of 1-61 higher education campus that is not covered by Subsection (b). The 1-62 institution may not issue a permit to a student of the institution 1-63 for driving or parking a motor vehicle on institutional property 2-1 unless the institution provides written notice to the student that 2-2 failure to register the vehicle in this state or to display a 2-3 current and appropriate inspection certificate issued under Chapter 2-4 548, Transportation Code, may violate state law if the owner of the 2-5 vehicle resides in this state. 2-6 SECTION 2. (a) Except as provided by Subsection (b) of this 2-7 section, this Act takes effect September 1, 2001. 2-8 (b) Section 51.207(b), Education Code, as added by this Act, 2-9 takes effect January 1, 2002. 2-10 (c) Sections 51.207(b) and (d), Education Code, as added by 2-11 this Act, do not affect the validity of a permit for driving or 2-12 parking a vehicle on property of an institution of higher education 2-13 issued by the institution before January 1, 2002. 2-14 * * * * *
