 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to the transfer of certain cases from a district court of
1-10     a judicial district to a newly created district court of that
1-11     judicial district.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1. Subchapter A, Chapter 24, Government Code, is
1-14     amended by adding Section 24.022 to read as follows:
1-15           Sec. 24.022.  EFFECT OF TRANSFER OF CERTAIN CASES FOLLOWING
1-16     CREATION OF ADDITIONAL COURT. (a)  On the creation of an additional
1-17     district court in a county,  an existing district court in the
1-18     county may transfer to the new court a case regarding a child who
1-19     is subject to the continuing exclusive jurisdiction of the existing
1-20     court under Title 5, Family Code, regardless of whether the case is
1-21     pending in the existing court or the existing court rendered a
1-22     final order in the case.
1-23           (b)  The district court to which the case is transferred
1-24     under this section acquires continuing exclusive jurisdiction under
1-25     Title 5, Family Code, over the child.
1-26           SECTION 2. The change in law made by Section 24.022,
1-27     Government Code, as added by this Act, applies to a case
1-28     transferred from a district court of a judicial district to a newly
1-29     created district court of that district, regardless of whether the
1-30     case is transferred before, on, or after the effective date of this
1-31     Act.
1-32           SECTION 3.  This Act takes effect immediately if it receives
1-33     a vote of two-thirds of all the members elected to each house, as
1-34     provided by Section 39, Article III, Texas Constitution.  If this
1-35     Act does not receive the vote necessary for immediate effect, this
1-36     Act takes effect September 1, 2001.
