                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a trust fund for the purpose of maintaining and
 1-3     preserving the Capitol, the General Land Office Building, their
 1-4     contents, and their grounds.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 443.0103, Government Code, is reenacted
 1-7     and amended to read as follows:
 1-8           Sec. 443.0103.  CAPITAL [CAPITOL] RENEWAL TRUST FUND
 1-9     [ACCOUNT]. (a)  The capital [Capitol] renewal trust fund is created
1-10     as a trust fund outside the treasury with the comptroller and shall
1-11     be administered by the board, as a trustee on behalf of the people
1-12     of this state, to maintain and preserve the Capitol, the General
1-13     Land Office Building, their contents, and their grounds.  The fund
1-14     [account is a special account in the general revenue fund and]
1-15     consists of money transferred to [appropriated for the purpose of]
1-16     the fund:
1-17                 (1)  at the direction of the legislature; or
1-18                 (2)  in accordance with this section [account].
1-19           (b)  Money in the fund [account] may be used only for the
1-20     purpose of maintaining and preserving the Capitol, the General Land
1-21     Office Building, their contents, and their grounds.
1-22           (c)  The [pro rata portion of] interest received from
1-23     investment of money in the [general revenue] fund shall be credited
1-24     to the fund [account].
 2-1           (d)  The board may transfer money from any account of the
 2-2     Capitol fund to the capital renewal trust fund, other than money
 2-3     that was donated to the board, derived from a security or other
 2-4     thing of value donated to the board, or earned as interest or other
 2-5     income on a donation to the board, if the board determines that
 2-6     after the transfer there will be a sufficient amount of money in
 2-7     the applicable account of the Capitol fund to accomplish the
 2-8     purposes for which the account was created.  [The account is exempt
 2-9     from the application of Sections 403.095 and 404.071.]
2-10           SECTION 2. On August 31, 2001, the comptroller shall transfer
2-11     the unexpended balance of the appropriations to the State
2-12     Preservation Board for the state fiscal biennium ending August 31,
2-13     2001, not to exceed $6.7 million, to the capital renewal trust fund
2-14     established under Section 443.0103, Government Code, as amended by
2-15     this Act.
2-16           SECTION 3. This Act takes effect August 31, 2001.
