                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to transferring sick leave between immediate family
 1-3     members who are state employees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter G, Chapter 661, Government Code, is
 1-6     amended by adding Section 661.207 to read as follows:
 1-7           Sec. 661.207.  DONATION OF SICK LEAVE TO FAMILY MEMBER. (a)
 1-8     A state employee may transfer unused balances of the employee's
 1-9     accumulated sick leave directly to another state employee if the
1-10     other state employee is:
1-11                 (1)  the employee's spouse; or
1-12                 (2)  related to the employee within the first degree of
1-13     consanguinity.
1-14           (b)  The comptroller shall adopt rules that affected state
1-15     agencies must follow to efficiently ensure that the donated hours
1-16     of sick leave are deducted from the sick leave balances of the
1-17     donating state employee and credited to the benefit of the other
1-18     state employee.
1-19           (c)  This section does not affect an employee's ability to
1-20     contribute time to or use time from a sick leave pool created under
1-21     Subchapter A.
1-22           SECTION 2. This Act takes effect September 1, 2001.
