 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to the maximum inmate population of facilities operated by
1-10     municipalities.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Chapter 361.065, Local Government Code, is
1-13     amended as follows:
1-14           Sec. 361.065.  MAXIMUM INMATE POPULATION.  A facility
1-15     authorized by this subchapter must be designed, constructed,
1-16     operated, and maintained to hold not more than an average daily
1-17     population of 2,000 [500] inmates.  [This population requirement
1-18     does not apply to a facility that is under construction or
1-19     completed before August 3, 1987.]
1-20           SECTION 2.  This Act takes effect immediately if it receives
1-21     a vote of two-thirds of all the members elected to each house, as
1-22     provided by Section 39, Article III, Texas Constitution.  If this
1-23     Act does not receive the vote necessary for immediate effect, this
1-24     Act takes effect September 2, 2001.
