                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to employee organization consultation policies adopted by
 1-3     the boards of trustees of school districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter A, Chapter 22, Education Code, is
 1-6     amended by adding Section 22.007 to read as follows:
 1-7           Sec. 22.007.  EMPLOYEE ORGANIZATION CONSULTATION POLICIES.
 1-8           (a)  The board of trustees of a school district may adopt a
 1-9     policy under which employee organizations are consulted concerning
1-10     district educational matters specified by the policy.
1-11           (b)  A policy the board of trustees adopts under this
1-12     section:
1-13                 (1)  must permit a representative of an organization
1-14     that represents public school employees to consult directly with
1-15     the board or the board's designee concerning educational matters
1-16     specified by the policy if at least five percent of the employees
1-17     in the district are members of the organization and the
1-18     organization is a nonprofit corporation incorporated under the
1-19     Texas Non-Profit Corporation Act (Article 1396-1.01 et seq.,
1-20     Vernon's Texas Civil Statutes); and
1-21                 (2)  may not exclude from consultation an employee
1-22     organization described by this subsection.
1-23           (c)  The board of trustees may establish criteria to provide
 2-1     for proportional representation of the employee organizations
 2-2     described by Subsection (b) based on the number of employees in the
 2-3     district who are dues-paying members of each organization.
 2-4           SECTION 2.  This Act takes effect September 1, 2001.
