 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to fees charged by district and county clerks for copies
1-10     of records.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1. Section 552.265, Government Code, is amended to
1-13     read as follows:
1-14           Sec. 552.265.  CHARGE FOR PAPER COPY [CERTIFIED RECORD]
1-15     PROVIDED BY DISTRICT OR COUNTY CLERK. The charge for providing a
1-16     paper copy made by a district or county clerk's office shall be the
1-17     charge provided by Chapter 51 of this code, Chapter 118, Local
1-18     Government Code, or other applicable law.
1-19           SECTION 2. Section 118.011, Local Government Code, is amended
1-20     by adding Subsection (e) to read as follows:
1-21           (e)  A county clerk who provides a copy in a format other
1-22     than paper of a record maintained by the clerk shall provide the
1-23     copy and charge a fee in accordance with Sections 552.231 and
1-24     552.262, Government Code.
1-25           SECTION 3.  This Act takes effect immediately if it receives
1-26     a vote of two-thirds of all the members elected to each house, as
1-27     provided by Section 39, Article III, Texas Constitution.  If this
1-28     Act does not receive the vote necessary for immediate effect, this
1-29     Act takes effect September 1, 2001.
