1-7 Amend HB 2877 as follows:
1-8 On page 2, delete SECTION 3 (lines 15-25) and substitute in lieu
1-9 thereof,
1-10 SECTION 3. Section 443.023, Government Code, is amended to
1-11 read as follows:
1-12 Sec. 443.023. PURCHASE AND LEASE REQUIREMENTS FOR CERTAIN
1-13 EXPENDITURES. Subtitle D, Title 10, does not apply to a purchase
1-14 or lease under this chapter. The executive director, as
1-15 appropriate, may approve in writing the purchase or lease of goods
1-16 and services needed to repair or improve an area within the
1-17 Capitol, Capitol extension, Capitol grounds, or General Land Office
1-18 building, if the cost of the purchase or lease will not exceed
1-19 [$15,000] $50,000. The executive director shall notify the board in
1-20 writing of any expenditures in excess of [$15,000] $50,000 made under
1-21 this chapter.
1-22 A BILL TO BE ENTITLED
1-23 AN ACT
1-24 relating to the operations, powers, and duties of the State
1-25 Preservation Board.
1-26 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-27 SECTION 1. Section 443.006, Government Code, is amended by
1-28 amending Subsection (b) and adding Subsection (c) to read as
1-29 follows:
1-30 (b) The curator of the Capitol shall:
1-31 (1) assist in matters dealing with the preservation of
1-32 historic materials;
1-33 (2) develop and maintain a registration system and
1-34 inventory of the contents of the Capitol and the General Land
1-35 Office Building and their grounds;
1-36 (3) develop a program to purchase or accept by
1-37 donation, permanent loan, or outside funding items of historical
1-38 significance that were at one time in the buildings and that are
1-39 not owned by the state;
1-40 (4) develop a program to locate and acquire
1-41 state-owned items of historical significance that were at one time
1-42 in the buildings;
1-43 (5) develop a collections policy regarding the items
1-44 of historic significance as identified in the registration system
1-45 and inventory for the approval of the board;
1-46 (6) make recommendations on conservation needs and
1-47 make arrangements to contract for conservation services for objects
1-48 of significance;
1-49 (7) make recommendations for the transfer or loan of
1-50 objects of significance as detailed in the approved collections
1-51 policy;
1-52 (8) develop for board approval a furnishings plan for
1-53 the placement and care of objects under the care of the curator;
1-54 and
1-55 (9) make recommendations to transfer, sell, or
1-56 otherwise dispose of unused surplus property that is not of
1-57 significance as defined in the collections policy and by the
1-58 registration system and inventory prepared by the curator, in the
1-59 manner provided by Chapter 2175[;]
1-60 [(10) approve all exhibits placed in the buildings;
1-61 and]
1-62 [(11) make a good-faith effort, with the board and the
1-63 architect, to assist Texas businesses to receive a significant
2-1 percentage of the total value of all contract awards for the
2-2 purchase of supplies, materials, services, and equipment that are
2-3 made throughout the duration of the restoration project].
2-4 (c) The curator shall develop the collections policy with
2-5 the assistance of a review committee composed of five members whose
2-6 qualifications, tenure, and duties are defined by the executive
2-7 director. Chapter 2110 does not apply to the review committee.
2-8 SECTION 2. Chapter 443, Government Code, is amended by
2-9 adding Section 443.0153 to read as follows:
2-10 Sec. 443.0153. PARKING FEES NOT SUBJECT TO SALES TAX.
2-11 Parking fees paid through parking meters maintained under this
2-12 chapter and parking fees paid in a visitor parking facility under
2-13 this chapter or Chapter 445 are exempt from the application of the
2-14 tax imposed by Chapter 151, Tax Code.
2-15 SECTION 3. Section 443.023, Government Code, is amended to
2-16 read as follows:

2-26 SECTION 4. Chapter 443, Government Code, is amended by
2-27 adding Section 443.0231 to read as follows:
2-28 Sec. 443.0231. INFORMATION TECHNOLOGIES. Chapter 2054 does
2-29 not apply to the board.
2-30 SECTION 5. Section 443.025(a), Government Code, is amended
2-31 to read as follows:
2-32 (a) Title to the historic property Woodlawn, also commonly
2-33 known as Pease Mansion and Shivers Mansion, located at No. 6 Niles
2-34 Road in Austin, is in the name of the board. The board may
2-35 [shall]:
2-36 (1) preserve, maintain, restore, and furnish the
2-37 building;
2-38 (2) preserve, maintain, and restore its contents and
2-39 grounds; and
2-40 (3) otherwise provide for use of the building and
2-41 grounds.
2-42 SECTION 6. Subchapter F, Chapter 411, Government Code, is
2-43 amended by adding Section 411.1145 to read as follows:
2-44 Sec. 411.1145. ACCESS TO CRIMINAL HISTORY RECORD
2-45 INFORMATION: STATE PRESERVATION BOARD. (a) The State Preservation
2-46 Board is entitled to obtain criminal history record information
2-47 maintained by the department that relates to a person who is an
2-48 employee, volunteer, or intern, or an applicant to be an employee,
2-49 volunteer, or intern, in a position that involves:
2-50 (1) handling money or checks;
2-51 (2) working in the Capitol or another area designated
2-52 by the executive director as security sensitive; or
2-53 (3) direct contact with persons under 18 years of age.
2-54 (b) Criminal history record information obtained by the
2-55 board under this section may not be released or disclosed to any
2-56 person except on court order or with the consent of the person who
2-57 is the subject of the information.
2-58 SECTION 7. Section 445.011, Government Code, is amended by
2-59 adding Subsections (g) and (h) to read as follows:
2-60 (g) The museum may establish a membership program.
2-61 (h) Notwithstanding other law, for purposes of Subchapter H,
2-62 Chapter 659, as added by Chapter 76, Acts of the 74th Legislature,
2-63 Regular Session, 1995:
2-64 (1) the museum is considered an eligible charitable
2-65 organization entitled to participate in a state employee charitable
2-66 campaign under Subchapter H, Chapter 659; and
2-67 (2) a state employee is entitled to authorize a
2-68 deduction for contributions to the museum, including contributions
2-69 for museum membership, as a charitable contribution under Section
3-1 659.132, and the museum may use the contributions for museum
3-2 purposes.
3-3 SECTION 8. Sections 443.0101(d) and 445.002(c), Government
3-4 Code, are repealed.
3-5 SECTION 9. The Bob Bullock Texas State History Museum is
3-6 entitled to participate in the state employee charitable campaign
3-7 conducted during the autumn of 2001 without regard to any
3-8 limitation on the time during which an organization must apply to
3-9 participate in the campaign.
3-10 SECTION 10. This Act takes effect immediately if it receives
3-11 a vote of two-thirds of all the members elected to each house, as
3-12 provided by Section 39, Article III, Texas Constitution. If this
3-13 Act does not receive the vote necessary for immediate effect, this
3-14 Act takes effect on the 91st day after the last day of the
3-15 legislative session.
