                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to cross-filing with more than one political party by
 1-3     candidates for certain judicial offices.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 276, Election Code, is amended by adding
 1-6     Section 276.010 to read as follows:
 1-7           Sec. 276.010.  CROSS-FILING BY CANDIDATES FOR CERTAIN
 1-8     JUDICIAL OFFICES.  (a)  This section applies only to a candidate
 1-9     for a judicial office  regularly filled at the general election for
1-10     state and county officers, other than the office of constitutional
1-11     county judge or justice of the peace, notwithstanding and in
1-12     addition to other applicable provisions of this code.
1-13           (b)  A candidate for a judicial office may seek nomination in
1-14     the primary election or by the convention of more than one
1-15     political party. The candidate may seek election in the general
1-16     election for state and county officers as the nominee of one or
1-17     more parties.
1-18           (c)  If a judicial candidate's name appears on the ballot
1-19     more than once for the same office, the votes received in each
1-20     position shall be added together to determine the total number of
1-21     votes received by the candidate for that office.
1-22           (d)  The secretary of state shall prescribe any additional
1-23     procedures necessary to implement this section.
1-24           SECTION 2.  This Act takes effect September 1, 2001.
