                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the power of the attorney general to represent the
 1-3     state before the United States Supreme Court.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 402.021, Government Code, is amended to
 1-6     read as follows:
 1-7           Sec. 402.021.  REPRESENTATION OF STATE. (a)  The attorney
 1-8     general shall prosecute and defend all actions in which the state
 1-9     is interested before the supreme court and courts of appeals.
1-10           (b)  After giving notice to and consulting with the attorney
1-11     representing a governmental entity, the attorney general may
1-12     exclusively represent the state in all matters before the United
1-13     States Supreme Court.
1-14           SECTION 2.  This Act takes effect September 1, 2001.
