A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to compensation for the training of and for services
1-3 rendered at a polling place by certain election officers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 32.091, Election Code, is amended by
1-6 amending Subsection (a) and adding Subsection (c) to read as
1-7 follows:
1-8 (a) Except as provided by Subsection (c), an [An] election
1-9 judge or clerk is entitled to compensation for services rendered at
1-10 a precinct polling place at an hourly rate not to exceed $6. A
1-11 judge or clerk may be compensated at that rate for services
1-12 rendered under Section 62.014(c).
1-13 (c) For an election ordered by the governor or a county
1-14 authority or for a primary election, the maximum rate is $7 if the
1-15 election officer attended a training program as provided by
1-16 Subchapter F.
1-17 SECTION 2. Section 32.112, Election Code, is amended to read
1-18 as follows:
1-19 Sec. 32.112. EXPENSE OF TRAINING JUDGES. The governing body
1-20 of a political subdivision may appropriate funds to:
1-21 (1) compensate its election judges, early voting
1-22 clerk, and deputy early voting clerks in charge of early voting
1-23 polling places for attending training programs, at an hourly rate
1-24 not to exceed the maximum rate of compensation of an election judge
2-1 for services rendered at a precinct polling place or, if
2-2 applicable, for attendance of a training program under Section
2-3 32.114; and
2-4 (2) pay the expenses of conducting the programs.
2-5 SECTION 3. Section 32.114, Election Code, is amended by
2-6 adding Subsection (e) to read as follows:
2-7 (e) An election judge, early voting clerk, or deputy early
2-8 voting clerk in charge of an early voting polling place is entitled
2-9 to compensation for attending the training program at an hourly
2-10 rate not to exceed $7.
2-11 SECTION 4. Section 173.005, Election Code, is amended to read
2-12 as follows:
2-13 Sec. 173.005. STATE COMPENSATION FOR TRAINING ELECTION
2-14 JUDGES. [(a)] The maximum hourly rate payable with state funds in
2-15 a particular primary election year to election judges serving in a
2-16 primary election for attending training programs is the same as the
2-17 maximum rate prescribed by this code for [a political
2-18 subdivision's] compensation for attending a training program for
2-19 election judges appointed to serve in elections ordered by the
2-20 governor or a county authority [of its election judges for the same
2-21 activity].
2-22 [(b) The secretary of state may deny payment of state funds
2-23 to a county executive committee for the purpose of training
2-24 election judges or may limit the amount of payment made.]
2-25 SECTION 5. This Act takes effect September 1, 2001.
