No. 2907 77R5764 MXM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the review by the Parks and Wildlife Department of 1-3 state land proposed to be sold. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter E, Chapter 31, Natural Resources Code, 1-6 is amended by adding Sections 31.1575 and 31.1576 to read as 1-7 follows: 1-8 Sec. 31.1575. INFORMATION TO AND REVIEW BY PARKS AND 1-9 WILDLIFE DEPARTMENT. (a) Not later than the 120th day before the 1-10 date of a proposed sale, each state agency must notify the Parks 1-11 and Wildlife Department of any proposed sale of real property owned 1-12 by the state. 1-13 (b) Not later than the 60th day after the date of receiving 1-14 notification under Subsection (a), the Parks and Wildlife 1-15 Department shall complete a review of the land proposed for sale to 1-16 determine its value to the state for conservation or recreation 1-17 purposes. 1-18 Sec. 31.1576. MEMORANDUM OF UNDERSTANDING WITH PARKS AND 1-19 WILDLIFE DEPARTMENT. The Parks and Wildlife Department and the land 1-20 office shall enter into a memorandum of understanding that 1-21 authorizes the Parks and Wildlife Department to review the 1-22 conservation and recreational value of any real property owned by 1-23 the state that the division recommends for sale. 1-24 SECTION 2. (a) This Act takes effect immediately if it 2-1 receives a vote of two-thirds of all the members elected to each 2-2 house, as provided by Section 39, Article III, Texas Constitution. 2-3 If this Act does not receive the vote necessary for immediate 2-4 effect, this Act takes effect September 1, 2001. 2-5 (b) The change in law made by this Act applies only to state 2-6 real property offered for sale on or after the effective date of 2-7 this Act.
