A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the regulation of pull-tab or instant bingo.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Sections 2001.002(24) and (25), Occupations Code,
1-5 are amended to read as follows:
1-6 (24) "Pull-tab bingo" means a form of bingo played
1-7 using tickets with perforated break-open tabs, or using cards made
1-8 of paper or paper products, the face of which is covered or
1-9 otherwise hidden from view to conceal numbers, letters, or symbols,
1-10 some of which have been designated in advance as prize winners.
1-11 The term includes games commonly known as "instant bingo" and
1-12 "break-open bingo."
1-13 (25) "Pull-tab dispenser" means an electronic or
1-14 mechanical device that dispenses a pull-tab bingo ticket or card
1-15 after a person inserts money into the device, and includes a device
1-16 commonly known as a "ticket dispenser" or "card dispenser."
1-17 SECTION 2. Section 2001.408, Occupations Code, is amended to
1-18 read as follows:
1-19 Sec. 2001.408. OTHER METHODS FOR PLAYING BINGO. Subject to
1-20 the commission's rules, bingo may be played using a pull-tab bingo
1-21 ticket or card.
1-22 SECTION 3. Sections 2001.410(b) and (d), Occupations Code,
1-23 are amended to read as follows:
1-24 (b) The price of a pull-tab ticket or card sold by a
2-1 pull-tab dispenser may not exceed $1.
2-2 (d) A bingo game representation or combination of bingo
2-3 games must be shown on a ticket or card dispensed from a pull-tab
2-4 dispenser.
2-5 SECTION 4. Section 2001.457(d), Occupations Code, is amended
2-6 to read as follows:
2-7 (d) In this section:
2-8 (1) "Adjusted gross receipts" means gross receipts
2-9 less the amount of cost of goods purchased by an organization and
2-10 prizes paid in the preceding quarter.[; and]
2-11 (2) "Cost of goods purchased by an organization" means
2-12 the cost of bingo paper or pull-tab bingo tickets or cards
2-13 purchased by the organization.
2-14 SECTION 5. This Act takes effect immediately if it receives
2-15 a vote of two-thirds of all the members elected to each house, as
2-16 provided by Section 39, Article III, Texas Constitution. If this
2-17 Act does not receive the vote necessary for immediate effect, this
2-18 Act takes effect September 1, 2001.
