A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the advertising of competitive bids of certain local 1-3 governments. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 271.906, Local Government Code, is added 1-6 to read as follows: 1-7 Sec. 271.906. ELECTRONIC NOTICE. (a) In lieu of the notice 1-8 required in Sections 44.031(g) or 44.033(b), Education Code, a 1-9 school district may publish the required notice for at least two 1-10 weeks before the deadline for receiving bids, proposals, or 1-11 reponses to a request for qualifications on either: 1-12 (1) the district's website, provided there is a direct 1-13 link from the district's home page, and on the state's website for 1-14 posting local government procurement notices; or 1-15 (2) for an interlocal contract in accordance with 1-16 Section 44.031(a)(5), the website of the district's administrative 1-17 agency created under the Interlocal Cooperation Act, Chapter 791, 1-18 Government Code, provided there is a direct link to the 1-19 administrative agency website's publicly accessible postings from 1-20 the district's home page. 1-21 (b) A school district that publishes notice under this 1-22 section shall clearly identify the link on its home page as the 1-23 link to public notice of bids, proposals, or responses. 2-1 (c) In lieu of the notice required in Sections 262.025(a), 2-2 263.007(b), 263.153, or 271.055, Local Government Code, a county 2-3 may publish the required notice for at least two weeks before the 2-4 date of the bid opening, the date of the award of the sale or 2-5 lease, the date of sale, or the date for public opening of the bids 2-6 and the reading of the bids aloud, as applicable, on the county's 2-7 website. A county that publishes notice under this subsection 2-8 shall: 2-9 (1) have a direct link on the county's home page that 2-10 clearly identify the link as the link to public notice of bids, 2-11 sales, or leases; or 2-12 (2) have the notice accessible with the universal 2-13 resource locator address of 2-14 "http://www.co.(county-name).tx.us/notices/index.htm". 2-15 SECTION 2. This Act takes effect immediately if it receives 2-16 a vote of two-thirds of all the members elected to each house, as 2-17 provided by Section 39, Article III, Texas Constitution. If this 2-18 Act does not receive the vote necessary for immediate effect, this 2-19 Act takes effect September 1, 2001.
