No. 2928 77R7636 JMG-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to an interim committee to study debit card fraud on 1-3 certain individuals. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. DEFINITION. In this Act, "elderly individual" has 1-6 the meaning assigned by Section 22.04(c), Penal Code. 1-7 SECTION 2. DEBIT CARD FRAUD ON ELDERLY INDIVIDUALS INTERIM 1-8 COMMITTEE. The debit card fraud on elderly individuals interim 1-9 committee is established to study and report on the prevention and 1-10 detection of debit card fraud on elderly individuals. 1-11 SECTION 3. MEMBERSHIP; OFFICERS. (a) As soon as practicable 1-12 after the effective date of this Act, the committee shall be 1-13 appointed as follows: 1-14 (1) one member appointed by the governor; 1-15 (2) one member appointed by the lieutenant governor; 1-16 (3) two members appointed by the banking commissioner 1-17 of Texas, with one of the appointees being a banker; and 1-18 (4) one member from the attorney general's consumer 1-19 protection division, appointed by the division chief of the 1-20 consumer protection division. 1-21 (b) The committee members shall select from among their 1-22 membership a presiding officer. 1-23 SECTION 4. ASSISTANCE; EXPENSES. (a) The committee may 1-24 request assistance and information, other than confidential 2-1 information, from the attorney general. The attorney general shall 2-2 provide the assistance and information requested to the extent 2-3 practicable. 2-4 (b) Members of the committee serve without compensation. 2-5 SECTION 5. COMMITTEE DUTIES. The committee shall study and 2-6 evaluate: 2-7 (1) prevention of debit card fraud on elderly 2-8 individuals; 2-9 (2) detection of debit card fraud on elderly 2-10 individuals; 2-11 (3) the effect of possible enhancements of criminal 2-12 penalties for debit card fraud on elderly individuals; 2-13 (4) the effect of placing an identification picture on 2-14 the debit cards of elderly individuals; and 2-15 (5) other topics the committee considers appropriate. 2-16 SECTION 6. REPORT. Not later than December 31, 2002, the 2-17 committee shall file a report of the committee's activities, 2-18 findings, and recommendations with the governor and lieutenant 2-19 governor. The report shall include any recommendations for 2-20 legislative or administrative action the committee considers 2-21 appropriate. 2-22 SECTION 7. EXPIRATION. The committee is abolished and this 2-23 Act expires September 1, 2003. 2-24 SECTION 8. EFFECTIVE DATE. This Act takes effect immediately 2-25 if it receives a vote of two-thirds of all the members elected to 2-26 each house, as provided by Section 39, Article III, Texas 2-27 Constitution. If this Act does not receive the vote necessary for 3-1 immediate effect, this Act takes effect September 1, 2001.
