By Marchant H.B. No. 2929 77R7029 ATP-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to a restitution lien for the state to secure fines or 1-3 costs in a misdemeanor case. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 2(b), Article 42.22, Code of Criminal 1-6 Procedure, is amended to read as follows: 1-7 (b) The state also has a restitution lien to secure the: 1-8 (1) amount of fines or costs entered against a 1-9 defendant in the judgment in a felony or misdemeanor criminal case; 1-10 and 1-11 (2) amount of reimbursement for costs of confinement 1-12 ordered under Article 42.038. 1-13 SECTION 2. (a) The change in law made by this Act applies 1-14 only to a judgment in a criminal case for an offense committed on 1-15 or after the effective date of this Act. For purposes of this 1-16 section, an offense is committed before the effective date of this 1-17 Act if any element of the offense occurs before that date. 1-18 (b) A judgment in a criminal case for an offense committed 1-19 before the effective date of this Act is covered by the law in 1-20 effect when the offense was committed, and the former law is 1-21 continued in effect for that purpose. 1-22 SECTION 3. This Act takes effect September 1, 2001.
