1-1 AN ACT
1-2 relating to the posting of notice for water discharge permits.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 5.552(b), Water Code, as added by Chapter
1-5 1350, Acts of the 76th Legislature, Regular Session, 1999, is
1-6 amended to read as follows:
1-7 (b) Not later than the 30th day after the date the executive
1-8 director determines the application to be administratively
1-9 complete:
1-10 (1) the applicant shall publish notice of intent to
1-11 obtain a permit at least once in the newspaper of largest
1-12 circulation in the county in which the facility to which the
1-13 application relates is located or proposed to be located or, if the
1-14 facility to which the application relates is located or proposed to
1-15 be located in a municipality, at least once in a newspaper of
1-16 general circulation in the municipality; and
1-17 (2) the chief clerk of the commission shall mail
1-18 notice of intent to obtain a permit to:
1-19 (A) the state senator and representative who
1-20 represent the general area in which the facility is located or
1-21 proposed to be located;
1-22 (B) the mayor and health authorities of the
1-23 municipality in which the facility is located or proposed to be
1-24 located;
2-1 (C) the county judge and health authorities of
2-2 the county in which the facility is located or proposed to be
2-3 located; and
2-4 (D) the river authority in which the facility is
2-5 located or proposed to be located if the application is under
2-6 Chapter 26, Water Code.
2-7 SECTION 2. (a) The change in law made by this Act to Section
2-8 5.552(b), Water Code, as added by Chapter 1350, Acts of the 76th
2-9 Legislature, Regular Session, 1999, applies only to an application
2-10 that is filed with the Texas Natural Resource Conservation
2-11 Commission on or after September 1, 2001.
2-12 (b) This Act takes effect September 1, 2001.
