No. 2947 1-2 (In the Senate - Received from the House April 23, 2001; 1-3 April 24, 2001, read first time and referred to Committee on 1-4 Natural Resources; May 10, 2001, reported favorably by the 1-5 following vote: Yeas 5, Nays 0; May 10, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the posting of notice for water discharge permits. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 5.552(b), Water Code, as added by Chapter 1-11 1350, Acts of the 76th Legislature, Regular Session, 1999, is 1-12 amended to read as follows: 1-13 (b) Not later than the 30th day after the date the executive 1-14 director determines the application to be administratively 1-15 complete: 1-16 (1) the applicant shall publish notice of intent to 1-17 obtain a permit at least once in the newspaper of largest 1-18 circulation in the county in which the facility to which the 1-19 application relates is located or proposed to be located or, if the 1-20 facility to which the application relates is located or proposed to 1-21 be located in a municipality, at least once in a newspaper of 1-22 general circulation in the municipality; and 1-23 (2) the chief clerk of the commission shall mail 1-24 notice of intent to obtain a permit to: 1-25 (A) the state senator and representative who 1-26 represent the general area in which the facility is located or 1-27 proposed to be located; 1-28 (B) the mayor and health authorities of the 1-29 municipality in which the facility is located or proposed to be 1-30 located; 1-31 (C) the county judge and health authorities of 1-32 the county in which the facility is located or proposed to be 1-33 located; and 1-34 (D) the river authority in which the facility is 1-35 located or proposed to be located if the application is under 1-36 Chapter 26, Water Code. 1-37 SECTION 2. (a) The change in law made by this Act to Section 1-38 5.552(b), Water Code, as added by Chapter 1350, Acts of the 76th 1-39 Legislature, Regular Session, 1999, applies only to an application 1-40 that is filed with the Texas Natural Resource Conservation 1-41 Commission on or after September 1, 2001. 1-42 (b) This Act takes effect September 1, 2001. 1-43 * * * * *
