                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of a judicial district composed of Waller
 1-3     County and the composition of the 9th and 155th judicial districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter C, Chapter 24, Government Code is
 1-6     amended by adding Section 24.558 to read as follows:
 1-7           Sec. 24.417TH JUDICIAL DISTRICT (WALLER COUNTY).
 1-8           SECTION 2.  Subchapter C, Chapter 24, Government Code is
 1-9     amended by changing Sec. 24.109 to read as follows:
1-10           Sec. 24.109.  9TH JUDICIAL DISTRICT (MONTGOMERY [AND WALLER
1-11     COUNTIES] County).
1-12           (a)  The 9th Judicial District is composed of Montgomery [and
1-13     Waller Counties] County.
1-14           [(b)  The 9th and 155th district courts have concurrent
1-15     jurisdiction in Waller County]
1-16           [(c)] (b)  The terms of the 9th District Court begin
1-17                 [(1)  in Montgomery County] on the first Monday in
1-18     January and the first Monday in July[; and].
1-19                 [(2)  in Waller County on the 10th Monday after the
1-20     first Monday in January and the 12th Monday after the first Monday
1-21     in July.]
1-22           SECTION 3.  Subchapter C, Chapter 24, Government Code is
1-23     amended by changing Sec. 24.254 to read as follows:
 2-1           Sec. 24.254.  155th Judicial District (Austin, and Fayette,
 2-2     [and Waller] Counties.
 2-3           (a)  The 155th Judicial District is composed of Austin, and
 2-4     Fayette, [and Waller] Counties.
 2-5           (b)  The terms of the 155th District Court begin:
 2-6                 (1)  in Austin County on the first Mondays in April and
 2-7     November; and
 2-8                 (2)  in Fayette County on the first Mondays in February
 2-9     and September; and
2-10                 [(3)  in Waller County on the first Mondays in January
2-11     and June.]
2-12           (c)  The sheriff of each county or the sheriff's deputy shall
2-13     attend the court as required by law or by the judge.
2-14           [(d)  Section 24.109, relating to the 9th District Court,
2-15     contains provisions applicable to both that court and the 155th
2-16     District Court.]
2-17           SECTION 4.  This Act takes effect September 1, 2001.
