No. 2967 77R8149 GJH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to gaming activities by certain Indian tribes. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Chapter 47, Penal Code, is amended by adding 1-5 Section 47.11 to read as follows: 1-6 Sec. 47.11. PERMISSIBLE GAMING ACTIVITY BY INDIAN TRIBE. (a) 1-7 The legislature finds that all Class I, Class II, and Class III 1-8 gaming activity under the Indian Gaming Regulatory Act (25 U.S.C. 1-9 Section 2701 et seq.), as amended, is permitted in this state and 1-10 does not violate any law of this state, including the Texas 1-11 Constitution. 1-12 (b) The attorney general, a prosecuting attorney, an agent 1-13 of the attorney general or a prosecuting attorney, or a law 1-14 enforcement officer may not use any public funds to conduct an 1-15 enforcement action against gaming activity described by Subsection 1-16 (a). 1-17 SECTION 2. This Act takes effect September 1, 2001.
