                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to state review of and funding for certain junior college
 1-3     courses offered for joint college and high school credit.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 130.008, Education Code, is amended by
 1-6     amending Subsection (c) and adding Subsections (e) and (f) to read
 1-7     as follows:
 1-8           (c)  Except as provided by Subsection (f), the [The] contact
 1-9     hours attributable to the enrollment of a high school student in a
1-10     course offered for joint high school and junior college credit
1-11     under this section shall be included in the contact hours used to
1-12     determine the junior college's proportionate share of the state
1-13     money appropriated and distributed to public junior colleges under
1-14     Sections 130.003 and 130.0031, even if the junior college waives
1-15     the tuition fee for the student under Subsection (b).
1-16           (e)  The Texas Higher Education Coordinating Board in its
1-17     review of the degree or certificate programs offered by a public
1-18     junior college or at other times the coordinating board determines
1-19     appropriate shall review each course offered by a junior college
1-20     for joint high school and junior college credit to determine
1-21     whether:
1-22                 (1)  the course complies with all applicable laws,
1-23     rules, and standards, including this section; and
1-24                 (2)  the quality of the course, considering all
 2-1     applicable factors, meets the standards required for a
 2-2     college-credit course.
 2-3           (f)  If the Texas Higher Education Coordinating Board
 2-4     determines that a course offered by a public junior college for
 2-5     joint high school and junior college credit does not meet the
 2-6     standards listed in Subsection (e), the coordinating board may:
 2-7                 (1)  require the junior college to make changes to the
 2-8     course in order to continue offering the course or to discontinue
 2-9     offering the course; or
2-10                 (2)  exclude all or a portion of the contact hours
2-11     attributable to any students enrolled in the course from the
2-12     contact hours used to determine the junior college's proportionate
2-13     share of the state money appropriated and distributed to public
2-14     junior colleges.
2-15           SECTION 2.  This Act takes effect immediately if it receives
2-16     a vote of two-thirds of all the members elected to each house, as
2-17     provided by Section 39, Article III, Texas Constitution.  If this
2-18     Act does not receive the vote necessary for immediate effect, this
2-19     Act takes effect September 1, 2001.
