A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to providing alcoholic beverages to a minor and providing
1-3 minors with a place to consume alcoholic beverages; providing
1-4 criminal penalties.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 106.06, Alcoholic Beverage Code, as
1-7 amended by Chapters 437 and 934, Acts of the 73rd Legislature,
1-8 Regular Session, 1993, is amended to read as follows:
1-9 Sec. 106.06. PURCHASE OF ALCOHOL FOR A MINOR; FURNISHING
1-10 ALCOHOL TO A MINOR. (a) A [Except as provided in Subsection (b) of
1-11 this section, a] person commits an offense if the person [he]
1-12 purchases an alcoholic beverage for or gives or with criminal
1-13 negligence makes available an alcoholic beverage to a minor [with
1-14 criminal negligence].
1-15 (b) [A person may purchase an alcoholic beverage for or give
1-16 an alcoholic beverage to a minor if he is the minor's adult parent,
1-17 guardian, or spouse, or an adult in whose custody the minor has
1-18 been committed by a court, and he is visibly present when the minor
1-19 possesses or consumes the alcoholic beverage.]
1-20 [(c)] An offense under this section is a Class A [B]
1-21 misdemeanor.
1-22 SECTION 2. Chapter 106, Alcoholic Beverage Code, is amended
1-23 by adding Section 106.061 to read as follows:
1-24 Sec. 106.061. PROVIDING LOCATION FOR MINOR TO CONSUME
2-1 ALCOHOLIC BEVERAGE. (a) A person commits an offense if the person
2-2 with criminal negligence provides a location for a minor to consume
2-3 an alcoholic beverage.
2-4 (b) An offense under this section is a Class A misdemeanor.
2-5 SECTION 3. (a) Section 106.06, as amended by this Act,
2-6 applies only to an offense committed on or after the effective date
2-7 of this Act. For purposes of this section, an offense is committed
2-8 before the effective date of this Act if any element of the offense
2-9 occurs before that date.
2-10 (b) An offense committed before the effective date of this
2-11 Act is covered by the law in effect when the offense was committed,
2-12 and the former law is continued in effect for that purpose.
2-13 SECTION 4. This Act takes effect September 1, 2001.
