                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to coal combustion waste.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 361.003(12), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6                 (12)  "Hazardous waste" means:
 1-7                       (A)  solid waste identified or listed as a
 1-8     hazardous waste by the administrator of the United States
 1-9     Environmental Protection Agency under the federal Solid Waste
1-10     Disposal Act, as amended by the Resource Conservation and Recovery
1-11     Act of 1976, as amended (42 U.S.C. Section 6901 et seq.); or
1-12                       (B)  coal combustion waste.
1-13           SECTION 2. This Act takes effect September 1, 2001.
