No. 3008 77R9258 MTB-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the issuance of special license plates for members of 1-3 Delta Sigma Theta Sorority. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter F, Chapter 502, Transportation Code, is 1-6 amended by adding Section 502.2735 to read as follows: 1-7 Sec. 502.2735. MEMBERS OF DELTA SIGMA THETA SORORITY. (a) 1-8 The department shall issue specially designed license plates for 1-9 passenger cars and light trucks owned by members or alumnae of 1-10 Delta Sigma Theta Sorority. 1-11 (b) License plates issued under this section to members or 1-12 alumnae of Delta Sigma Theta Sorority must include the words "Delta 1-13 Sigma Theta." 1-14 (c) The department shall issue license plates under this 1-15 section to a person who: 1-16 (1) applies to the assessor-collector of the county in 1-17 which the person resides on a form provided by the department; 1-18 (2) pays an annual fee of $25, in addition to the fee 1-19 prescribed by Section 502.161 or 502.162 and, if personalized 1-20 prestige license plates are issued, in addition to the fee 1-21 prescribed by Section 502.251; and 1-22 (3) submits proof that the person is eligible under 1-23 this section. 1-24 (d) Of each fee collected under Subsection (c)(2), $8 shall 2-1 be used by the department only to defray the cost of administering 2-2 this section. The department shall deposit the remainder of each 2-3 fee collected to the credit of the Delta Sigma Theta Sorority 2-4 account established by Section 7.025, Education Code. 2-5 (e) If the owner of a vehicle for which license plates were 2-6 issued under this section disposes of the vehicle during a 2-7 registration year, the owner shall return the special license 2-8 plates to the department. 2-9 SECTION 2. Subchapter B, Chapter 7, Education Code, is 2-10 amended by adding Section 7.025 to read as follows: 2-11 Sec. 7.025. DELTA SIGMA THETA SORORITY ACCOUNT. (a) The 2-12 Delta Sigma Theta Sorority account is a separate account in the 2-13 general revenue fund. The account is composed of money deposited 2-14 to the credit of the account under Section 502.2735, Transportation 2-15 Code. Money in the account may be used only for the purposes of 2-16 this section. 2-17 (b) The Texas Education Agency administers the account. The 2-18 agency may spend money credited to the account only to make grants 2-19 to benefit programs sponsored by the El Paso Alumnae Chapter of 2-20 Delta Sigma Theta Sorority. 2-21 SECTION 3. This Act takes effect immediately if it receives 2-22 a vote of two-thirds of all the members elected to each house, as 2-23 provided by Section 39, Article III, Texas Constitution. If this 2-24 Act does not receive the vote necessary for immediate effect, this 2-25 Act takes effect September 1, 2001.
