                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to resident tuition for certain nonresident students with
 1-3     a parent residing in the state.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter B, Chapter 54, Education Code, is
 1-6     amended by adding Section 54.0551 to read as follows:
 1-7           Sec. 54.0551.  CHANGE OF RESIDENCE; ONE PARENT REMAINING IN
 1-8     STATE. An individual who is 18 years of age or under or is a
 1-9     dependent and who, along with the individual's parents, was
1-10     formerly a resident of this state is entitled to pay tuition at the
1-11     rate provided for Texas residents if:
1-12                 (1)  the individual and the parent who is the
1-13     individual's managing conservator or who is the individual's joint
1-14     managing conservator with whom the individual primarily resides
1-15     change their legal residence from this state to another state; and
1-16                 (2)  the other parent who is the individual's
1-17     possessory conservator or who is the individual's joint managing
1-18     conservator with whom the individual does not primarily reside
1-19     continues to reside in this state and is not delinquent on the
1-20     payment of any child support.
1-21           SECTION 2.  (a)  This Act takes effect immediately if it
1-22     receives a vote of two-thirds of all the members elected to each
1-23     house, as provided by Section 39, Article III, Texas Constitution.
1-24     If this Act does not receive the vote necessary for immediate
 2-1     effect, this Act takes effect September 1, 2001.
 2-2           (b)  The change in law made by this Act applies only to
 2-3     tuition for a semester or term that begins on or after the
 2-4     effective date of this Act.
