                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the violation of an individual's civil rights on
 1-3     premises where alcoholic beverages are sold.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 104.01, Texas Alcoholic Beverage Code, is
 1-6     amended to read as follows:
 1-7           Sec. 104.01.  LEWD, IMMORAL, INDECENT CONDUCT.  No person
 1-8     authorized to sell beer at retail, nor his agent, servant, or
 1-9     employee, may engage in or permit conduct on the premises to the
1-10     retailer which is lewd, immoral, offensive to public decency,
1-11     including, but not limited to any of the following acts:
1-12                 (1)  the use of loud or vociferous or obscene, vulgar,
1-13     or indecent language, or permitting its use;
1-14                 (2)  the exposure of person or permitting a person to
1-15     expose his person;
1-16                 (3)  rudely displaying or permitting a person to rudely
1-17     display a pistol or other deadly weapon in a manner calculated to
1-18     disturb persons in the retail establishment;
1-19                 (4)  solicitation of any person to buy drinks for
1-20     consumption by the retailer or any of his employees;
1-21                 (5)  being intoxicated on the licensed premises;
1-22                 (6)  permitting lewd or vulgar entertainment or acts;
1-23                 (7)  permitting solicitations of persons for immoral or
1-24     sexual purposes;
 2-1                 (8)  failing or refusing to comply with state or
 2-2     municipal health or sanitary laws or ordinances; [or]
 2-3                 (9)  possession of a narcotic or any equipment used or
 2-4     designed for the administration of a narcotic or permitting a
 2-5     person on the licensed premises to do so; or
 2-6                 (10)  violation of an individual's civil rights or the
 2-7     discrimination against an individual on the basis of the
 2-8     individual's race, creed, or national origin.
