A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the general requirements for transfers of used motor
1-3 vehicles.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 520.022, Transportation Code, is amended
1-6 to read as follows:
1-7 Sec. 520.022. DELIVERY OF RECEIPT AND TITLE TO TRANSFEREE;
1-8 REMOVAL OF LICENSE PLATES; PENALTY. (a) A person, whether acting
1-9 for that person or another, who sells, trades, or otherwise
1-10 transfers a used motor vehicle shall:
1-11 (1) remove each license plate attached to the vehicle;
1-12 and
1-13 (2) deliver to the transferee at the time of delivery
1-14 of the vehicle:
1-15 (A) [(1)] the license receipt issued by the
1-16 department for registration of the vehicle, if the vehicle was
1-17 required to be registered at the time of the delivery; and
1-18 (B) [(2)] a properly assigned certificate of
1-19 title or other evidence of title as required under Chapter 501.
1-20 (b) A person commits an offense if the person violates this
1-21 section. An offense under this subsection is a misdemeanor
1-22 punishable by a fine not to exceed $200.
1-23 SECTION 2. Section 520.031(a), Transportation Code, as
1-24 amended by Chapters 836 and 1423, Acts of the 76th Legislature,
2-1 Regular Session, 1999, is reenacted and amended to read as follows:
2-2 (a) Not later than the first [20th] working day after the
2-3 date of receiving the documents under Section 520.022 or 520.0225,
2-4 the transferee of the used motor vehicle shall file with the county
2-5 assessor-collector:
2-6 (1) each document received under Section 520.022 [that
2-7 section]; or
2-8 (2) if appropriate, a document described by Section
2-9 520.0225(b)(1) or (2) and the certificate of title or other
2-10 evidence of title.
2-11 SECTION 3. (a) This Act takes effect September 1, 2001.
2-12 (b) The change in law made by this Act applies only to a
2-13 sale, trade, or transfer of a used motor vehicle on or after
2-14 September 1, 2001.
2-15 (c) The sale, trade, or transfer of a used motor vehicle
2-16 before September 1, 2001, is covered by the law in effect when the
2-17 sale, trade, or transfer occurred, and the former law is continued
2-18 in effect for that purpose.
