                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the transfer of control of PT 309 from the Parks and
 1-3     Wildlife Department to the Texas Historical Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  On November 1, 2001, the care, custody, and
 1-6     control of PT 309 is transferred from the Parks and Wildlife
 1-7     Department to the Texas Historical Commission.
 1-8           SECTION 2.  On November 1, 2001:
 1-9                 (1)  all functions and activities relating to PT 309
1-10     performed by the Parks and Wildlife Department immediately before
1-11     that date are transferred to the Texas Historical Commission;
1-12                 (2)  all employees of the Parks and Wildlife Department
1-13     who primarily perform duties related to PT 309 become employees of
1-14     the Texas Historical Commission;
1-15                 (3)  a rule or form adopted by the Parks and Wildlife
1-16     Commission that relates to PT 309 is a rule or form of the Texas
1-17     Historical Commission and remains in effect until amended or
1-18     replaced by that agency;
1-19                 (4)  a reference in law or an administrative rule to
1-20     the Parks and Wildlife Department that relates to PT 309 means the
1-21     Texas Historical Commission;
1-22                 (5)  a complaint, investigation, or other proceeding
1-23     before the Parks and Wildlife Department that is related to PT 309
1-24     is transferred without change in status to the Texas Historical
 2-1     Commission, and the Texas Historical Commission assumes, as
 2-2     appropriate and without a change in status, the position of the
 2-3     Parks and Wildlife Department in an action or proceeding to which
 2-4     the Parks and Wildlife Department is a party;
 2-5                 (6)  all money, contracts, leases, property, and
 2-6     obligations of the Parks and Wildlife Department related to PT 309
 2-7     are transferred to the Texas Historical Commission;
 2-8                 (7)  all property in the custody of the Parks and
 2-9     Wildlife Department related to PT 309 is transferred to the Texas
2-10     Historical Commission; and
2-11                 (8)  all unexpended and unobligated money appropriated
2-12     by the legislature for the Parks and Wildlife Department related to
2-13     PT 309 is transferred to the Texas Historical Commission.
2-14           SECTION 3.  Before November 1, 2001, the Parks and Wildlife
2-15     Department may agree with the Texas Historical Commission to
2-16     transfer any employees or property of the Parks and Wildlife
2-17     Department to the Texas Historical Commission to implement the
2-18     transfer required by this Act.
2-19           SECTION 4.  This Act takes effect immediately if it receives
2-20     a vote of two-thirds of all the members elected to each house, as
2-21     provided by Section 39, Article III, Texas Constitution.  If this
2-22     Act does not receive the vote necessary for immediate effect, this
2-23     Act takes effect September 1, 2001.
