                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the application form for coverage of children under the
 1-3     Medicaid or state child health plan program.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 62.103(c), Health and Safety Code, is
 1-6     amended to read as follows:
 1-7           (c)  The application form may not exceed one page in length
 1-8     and must be written in simple language designed to be easily
 1-9     understood.  The [To the extent possible, the application] form
1-10     shall be made available in languages other than English, as
1-11     determined to be appropriate by department rule.
1-12           SECTION 2. Section 32.025(b), Human Resources Code, is
1-13     amended to read as follows:
1-14           (b)  The department shall prescribe application forms for
1-15     persons who are not recipients of benefits under Chapter 31 of this
1-16     code or supplemental security income from the federal government
1-17     and shall  adopt rules for processing the applications. An
1-18     application form for a request for medical assistance provided to a
1-19     child younger than 19 years of age may not exceed one page in
1-20     length and must be written in simple language designed to be easily
1-21     understood.  The form shall be made available in languages other
1-22     than English, as determined to be appropriate by department rule.
1-23           SECTION 3. This Act takes effect September 1, 2001.
