                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the appointment of a county auditor in certain
 1-3     counties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 84.002, Local Government Code, is amended
 1-6     to read as follows:
 1-7           Sec. 84.002.  APPOINTMENT OF COUNTY AUDITOR. (a)  In a county
 1-8     with a population of 15,000 [10,000] or more, the district judges
 1-9     shall appoint a county auditor.
1-10           (b)  In a county with a population of less than 15,000
1-11     [10,000]:
1-12                 (1)  the district judges may appoint a county auditor
1-13     if the judges determine that the county's financial circumstances
1-14     warrant the appointment; and
1-15                 (2)  the district judges shall appoint a county auditor
1-16     if:
1-17                       (A)  the commissioners court finds that a county
1-18     auditor is necessary to carry out county business and enters an
1-19     order in its minutes stating the reason for this finding;
1-20                       (B)  the order is certified to the district
1-21     judges; and
1-22                       (C)  the district judges find the reason stated
1-23     by the commissioners court to be good and sufficient.
1-24           SECTION 2. This Act takes effect September 1, 2001.
