 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the appointment of a county auditor in certain
1-11     counties.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 84.002, Local Government Code, is amended
1-14     to read as follows:
1-15           Sec. 84.002.  APPOINTMENT OF COUNTY AUDITOR.  (a)  In a
1-16     county with a population of 10,200 [10,000] or more, the district
1-17     judges shall appoint a county auditor.
1-18           (b)  In a county with a population of less than 10,200
1-19     [10,000]:
1-20                 (1)  the district judges may appoint a county auditor
1-21     if the judges determine that the county's financial circumstances
1-22     warrant the appointment; and
1-23                 (2)  the district judges shall appoint a county auditor
1-24     if:
1-25                       (A)  the commissioners court finds that a county
1-26     auditor is necessary to carry out county business and enters an
1-27     order in its minutes stating the reason for this finding;
1-28                       (B)  the order is certified to the district
1-29     judges; and
1-30                       (C)  the district judges find the reason stated
1-31     by the commissioners court to be good and sufficient.
1-32           SECTION 2.  This Act takes effect September 1, 2001.
