                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the rules adopted by the Texas Natural Resource
 1-3     Conservation Commission.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter D, Chapter 5, Water Code, is amended by
 1-6     adding Section 5.1031 to read as follows:
 1-7           Sec. 5.1031.  RULES DEVELOPED WITH ADVISORY COMMITTEE. (a)
 1-8     The commission may not adopt a rule developed in consultation with
 1-9     an advisory committee or another group unless the committee or
1-10     group consists of equal numbers of representatives for each
1-11     distinct group of persons who will be affected by the rule in a
1-12     similar way.
1-13           (b)  A person affected by a rule adopted by the commission
1-14     who alleges that the rule was adopted in violation of this section
1-15     may, in accordance with Subchapter I, file suit seeking a
1-16     declaratory judgment that the rule is invalid.
1-17           SECTION 2. Section 5.1031, Water Code, as added by this Act,
1-18     applies only to a rule adopted by the Texas Natural Resource
1-19     Conservation Commission on or after the effective date of this Act.
1-20           SECTION 3. This Act takes effect September 1, 2001.
