1-1                                   AN ACT
 1-2     relating to the governing body and powers of the Salt Fork Water
 1-3     Quality District.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 7, Chapter 1139, Acts of the 76th
 1-6     Legislature, Regular Session, 1999, is amended by amending
 1-7     Subsections (a), (b), and (c) and adding Subsection (f) to read as
 1-8     follows:
 1-9           (a)  The district is governed by a board of five directors
1-10     appointed by the Commissioners Court of Stonewall County.
1-11           (b)  Three of the initial directors shall serve terms that
1-12     expire on September 1, 2003.  Two of the initial directors shall
1-13     serve terms that expire on September 1, 2002 [Initial directors
1-14     serve until permanent directors are elected under Section 9 of this
1-15     Act].
1-16           (c)  At the expiration of a term, the commissioners court
1-17     shall appoint a director to serve a term of two years. If a vacancy
1-18     occurs on the board of directors, the commissioners court shall
1-19     appoint a director to serve the remainder of that term [Permanent
1-20     directors serve concurrent two- year terms].
1-21           (f)  To be eligible to serve as a director, a person must be
1-22     a registered voter in Stonewall County.
1-23           SECTION 2. Section 8, Chapter 1139, Acts of the 76th
1-24     Legislature, Regular Session, 1999, is amended to read as follows:
 2-1           Sec. 8.  INTERGOVERNMENTAL AGREEMENTS. (a)  The district may
 2-2     enter into an agreement with a state agency,  political subdivision
 2-3     of the state, or other governmental entity to carry out the
 2-4     purposes of the district under terms and conditions to which the
 2-5     parties agree and for a period not to exceed 40 years, subject to
 2-6     renewal and extension if the parties agree.
 2-7           (b)  Advertising, sealed bids, and similar procedures are not
 2-8     required for the intergovernmental agreements described in
 2-9     Subsection (a).
2-10           (c)  The agreements described in Subsection (a)  may provide
2-11     for an exchange of goods, services, or commodities, such as an
2-12     exchange of natural gas for salt, with or without cash payments, if
2-13     the parties agree [INITIAL DIRECTORS.  The initial board of
2-14     directors is composed of:]
2-15                 [(1)  Bobby McGough;]
2-16                 [(2)  Larry Dickerson;]
2-17                 [(3)  Gary Myers;]
2-18                 [(4)  Mike Hill; and]
2-19                 [(5)  Pat Cumbie].
2-20           SECTION 3. Section 9, Chapter 1139, Acts of the 76th
2-21     Legislature, Regular Session, 1999, is repealed.
2-22           SECTION 4. The term of office for any person serving as a
2-23     member of the board of directors for the Salt Fork Water Quality
2-24     District as of August 31, 2001, expires on September 1, 2001.  The
2-25     Commissioners Court of Stonewall County, Texas, shall appoint
2-26     directors under Section 7, Chapter 1139, Acts of the 76th
2-27     Legislature, Regular Session, 1999, as amended by this Act, as soon
 3-1     as practicable after September 1, 2001.
 3-2           SECTION 5.  (a) The proper and legal notice of the intention
 3-3     to introduce this Act, setting forth the general substance of this
 3-4     Act, has been published as provided by law, and the notice and a
 3-5     copy of this Act have been furnished to all persons, agencies,
 3-6     officials, or entities to which they are required to be furnished
 3-7     by the constitution and other laws of this state, including the
 3-8     governor, who has submitted the notice and Act to the Texas Natural
 3-9     Resource Conservation Commission.
3-10           (b)  The Texas Natural Resource Conservation Commission has
3-11     filed its recommendations relating to this Act with the governor,
3-12     lieutenant governor, and speaker of the house of representatives
3-13     within the required time.
3-14           (c)  All requirements of the constitution and laws of this
3-15     state and the rules and procedures of the legislature with respect
3-16     to the notice, introduction, and passage of this Act are fulfilled
3-17     and accomplished.
3-18           SECTION 6. This Act takes effect September 1, 2001.
