 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the governing body and powers of the Salt Fork Water
 1-9     Quality District.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 7, Chapter 1139, Acts of the 76th
1-12     Legislature, Regular Session, 1999, is amended by amending
1-13     Subsections (a), (b), and (c) and adding Subsection (f) to read as
1-14     follows:
1-15           (a)  The district is governed by a board of five directors
1-16     appointed by the Commissioners Court of Stonewall County.
1-17           (b)  Three of the initial directors shall serve terms that
1-18     expire on September 1, 2003.  Two of the initial directors shall
1-19     serve terms that expire on September 1, 2002 [Initial directors
1-20     serve until permanent directors are elected under Section 9 of this
1-21     Act].
1-22           (c)  At the expiration of a term, the commissioners court
1-23     shall appoint a director to serve a term of two years. If a vacancy
1-24     occurs on the board of directors, the commissioners court shall
1-25     appoint a director to serve the remainder of that term [Permanent
1-26     directors serve concurrent two- year terms].
1-27           (f)  To be eligible to serve as a director, a person must be
1-28     a registered voter in Stonewall County.
1-29           SECTION 2. Section 8, Chapter 1139, Acts of the 76th
1-30     Legislature, Regular Session, 1999, is amended to read as follows:
1-31           Sec. 8.  INTERGOVERNMENTAL AGREEMENTS. (a)  The district may
1-32     enter into an agreement with a state agency,  political subdivision
1-33     of the state, or other governmental entity to carry out the
1-34     purposes of the district under terms and conditions to which the
1-35     parties agree and for a period not to exceed 40 years, subject to
1-36     renewal and extension if the parties agree.
1-37           (b)  Advertising, sealed bids, and similar procedures are not
1-38     required for the intergovernmental agreements described in
1-39     Subsection (a).
1-40           (c)  The agreements described in Subsection (a)  may provide
1-41     for an exchange of goods, services, or commodities, such as an
1-42     exchange of natural gas for salt, with or without cash payments, if
1-43     the parties agree [INITIAL DIRECTORS.  The initial board of
1-44     directors is composed of:]
1-45                 [(1)  Bobby McGough;]
1-46                 [(2)  Larry Dickerson;]
1-47                 [(3)  Gary Myers;]
1-48                 [(4)  Mike Hill; and]
1-49                 [(5)  Pat Cumbie].
1-50           SECTION 3. Section 9, Chapter 1139, Acts of the 76th
1-51     Legislature, Regular Session, 1999, is repealed.
1-52           SECTION 4. The term of office for any person serving as a
1-53     member of the board of directors for the Salt Fork Water Quality
1-54     District as of August 31, 2001, expires on September 1, 2001.  The
1-55     Commissioners Court of Stonewall County, Texas, shall appoint
1-56     directors under Section 7, Chapter 1139, Acts of the 76th
1-57     Legislature, Regular Session, 1999, as amended by this Act, as soon
1-58     as practicable after September 1, 2001.
1-59           SECTION 5.  (a) The proper and legal notice of the intention
1-60     to introduce this Act, setting forth the general substance of this
1-61     Act, has been published as provided by law, and the notice and a
1-62     copy of this Act have been furnished to all persons, agencies,
1-63     officials, or entities to which they are required to be furnished
1-64     by the constitution and other laws of this state, including the
 2-1     governor, who has submitted the notice and Act to the Texas Natural
 2-2     Resource Conservation Commission.
 2-3           (b)  The Texas Natural Resource Conservation Commission has
 2-4     filed its recommendations relating to this Act with the governor,
 2-5     lieutenant governor, and speaker of the house of representatives
 2-6     within the required time.
 2-7           (c)  All requirements of the constitution and laws of this
 2-8     state and the rules and procedures of the legislature with respect
 2-9     to the notice, introduction, and passage of this Act are fulfilled
2-10     and accomplished.
2-11           SECTION 6. This Act takes effect September 1, 2001.
