                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the penalty for failure to comply with certain traffic
 1-3     control devices.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 544.007, Transportation Code, is amended
 1-6     by adding Subsection (i) to read as follows:
 1-7           (i)  An offense under Subsection (d) is a Class C
 1-8     misdemeanor. The court may order that the driver's license of a
 1-9     person be suspended if the person is convicted of a second or
1-10     subsequent offense under Subsection (d) committed before the second
1-11     anniversary of the date of the most recent previous offense of
1-12     which the person was convicted.  The period of suspension is:
1-13                 (1)  for a second offense, 30 days; or
1-14                 (2)  for a subsequent offense, 30 days plus a number of
1-15     days computed by multiplying 30 days by the number of subsequent
1-16     offenses.
1-17           SECTION 2. This Act takes effect September 1, 2001.
1-18           SECTION 3. (a)  The change in law made by this Act applies
1-19     only to an offense committed on or after the effective date of this
1-20     Act.  For the purposes of this section, an offense is committed
1-21     before the effective date of this Act if any element of the offense
1-22     occurs before that date.
1-23           (b)  An offense committed before the effective date of this
 2-1     Act is governed by the law in effect when the offense was
 2-2     committed, and the former law is continued in effect for that
 2-3     purpose.
