                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to authorizing counties to regulate, after voter approval,
 1-3     manufactured home rental communities in the same manner as other
 1-4     subdivisions.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 232.007(b), Local Government Code, is
 1-7     amended to read as follows:
 1-8           (b)  Except as provided by Section 232.0071, a [A]
 1-9     manufactured home rental community is not a subdivision, and
1-10     Sections 232.001-232.006 do not apply to the community.
1-11           SECTION 2. Subchapter A, Chapter 232, Local Government Code,
1-12     is amended by adding Section 232.0071 to read as follows:
1-13           Sec. 232.0071.  MANUFACTURED HOME RENTAL COMMUNITIES
1-14     REGULATED AS SUBDIVISIONS ON VOTER APPROVAL. (a)  The commissioners
1-15     court of a county may order and hold an election in the county on
1-16     the question of granting the commissioners court the authority to
1-17     regulate manufactured home rental communities in the unincorporated
1-18     areas of the county in the same manner as the commissioners court
1-19     is authorized to regulate other subdivisions.
1-20           (b)  For an election under this section, the ballot shall be
1-21     prepared to permit voting for or against the proposition: "Granting
1-22     (name of county) the authority to regulate manufactured home rental
1-23     communities in the unincorporated areas of the county in the same
1-24     manner as the commissioners court is authorized to regulate other
 2-1     subdivisions."
 2-2           (c)  If a majority of the votes received on the question at
 2-3     the election approve the grant of authority, the commissioners
 2-4     court may regulate manufactured home rental communities under this
 2-5     subchapter in the same manner as the commissioners court regulates
 2-6     other subdivisions.
 2-7           SECTION 3.  This Act takes effect immediately if it receives
 2-8     a vote of two-thirds of all the members elected to each house, as
 2-9     provided by Section 39, Article III, Texas Constitution.  If this
2-10     Act does not receive the vote necessary for immediate effect, this
2-11     Act takes effect September 1, 2001.
