                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the establishment of an asthma and allergy research
 1-3     advisory committee in the Texas Department of Health.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. (a)  The commissioner of public health shall
 1-6     establish an asthma and allergy research advisory committee.
 1-7           (b)  The asthma and allergy research advisory committee is
 1-8     composed of nine members appointed by the governor, in consultation
 1-9     with the lieutenant governor and the speaker of the house of
1-10     representatives.
1-11           (c)  The governor shall select members of the asthma and
1-12     allergy research advisory committee based on the members'
1-13     experience, expertise, or special interest in asthma and allergy
1-14     and:
1-15                 (1)  asthma and allergy education;
1-16                 (2)  indoor air quality;
1-17                 (3)  the public school system and its dealings with
1-18     children with asthma and an allergy;
1-19                 (4)  epidemiology;
1-20                 (5)  pharmacology;
1-21                 (6)  parenting a child with asthma or an allergy; or
1-22                 (7)  immunology.
1-23           (d)  The commissioner of public health shall select a member
1-24     of the asthma and allergy research advisory committee to serve as
 2-1     the presiding officer of the committee.  The presiding officer may
 2-2     not be an officer or employee of the state.
 2-3           (e)  The asthma and allergy research advisory committee
 2-4     shall:
 2-5                 (1)  develop a plan to research asthma and allergy and
 2-6     medical conditions associated with asthma and allergy in this
 2-7     state;
 2-8                 (2)  assess the resources and talent of institutions in
 2-9     this state as possible sites for research opportunities;
2-10                 (3)  analyze the impact of asthma and allergy on the
2-11     economy of this state and on the health of the residents of this
2-12     state; and
2-13                 (4)  make recommendations to the legislature and
2-14     governor  concerning research programs in asthma and allergy and
2-15     funding alternatives for the programs.
2-16           (f)  The asthma and allergy research advisory committee shall
2-17     meet at least four times as determined by the presiding officer.  A
2-18     professional facilitator with experience in strategic planning
2-19     shall facilitate meetings of the committee.
2-20           (g)  A member of the asthma and allergy research advisory
2-21     committee may not receive compensation for service on the committee
2-22     but is entitled to reimbursement for reasonable and necessary
2-23     travel expenses incurred by the member while conducting the
2-24     business of the committee as provided by general law and the
2-25     General Appropriations Act.
2-26           (h)  Not later than December 1, 2002, the commissioner of
2-27     public health shall submit a report prepared by the committee to
 3-1     the governor, lieutenant governor, and speaker of the house of
 3-2     representatives regarding asthma and allergy that comprehensively
 3-3     addresses the issues listed in Subsection (e) of this section.
 3-4           SECTION 2.  The governor shall appoint members to the asthma
 3-5     and allergy research advisory committee not later than the 90th day
 3-6     after the effective date of this Act.
 3-7           SECTION 3.  The asthma and allergy research advisory
 3-8     committee is abolished January 1, 2003.
 3-9           SECTION 4.  This Act expires September 1, 2003.
3-10           SECTION 5.  This Act takes effect immediately if it receives
3-11     a vote of two-thirds of all the members elected to each house, as
3-12     provided by Section 39, Article III, Texas Constitution.  If this
3-13     Act does not receive the vote necessary for immediate effect, this
3-14     Act takes effect September 1, 2001.
