No. 3155 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the establishment of a pediatric diabetes research 1-3 advisory committee in the Texas Department of Health. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. (a) The commissioner of public health, in 1-6 consultation with the Texas Diabetes Council, shall establish a 1-7 pediatric diabetes research advisory committee. 1-8 (b) The pediatric diabetes research advisory committee is 1-9 composed of the chairman of the Texas Diabetes Council or that 1-10 person's designee and not more than 14 additional members appointed 1-11 by the commissioner of public health in consultation with the Texas 1-12 Diabetes Council as follows: 1-13 (1) one or more representatives of the Texas 1-14 Department of Health; 1-15 (2) one or more representatives of the Juvenile 1-16 Diabetes Research Foundation; 1-17 (3) one or more representatives of the American 1-18 Diabetes Association; 1-19 (4) one or more research professionals from academic 1-20 or biomedical research institutions in this state currently 1-21 involved in diabetes research; and 1-22 (5) one or more representatives of the health care 1-23 industry. 1-24 (c) The commissioner of public health shall select members 2-1 of the pediatric diabetes research advisory committee based on the 2-2 members' experience, expertise, or special interest in diabetes 2-3 and: 2-4 (1) ophthalmology; 2-5 (2) pediatric endocrinology; 2-6 (3) child health and development; 2-7 (4) neuropathy; 2-8 (5) genetics; 2-9 (6) cardiology; or 2-10 (7) immunology. 2-11 (d) The commissioner of public health, with recommendations 2-12 from the Texas Diabetes Council, shall select a member of the 2-13 pediatric diabetes research advisory committee to serve as the 2-14 presiding officer of the committee. The presiding officer may not 2-15 be an officer or employee of the state. 2-16 (e) The pediatric diabetes research advisory committee 2-17 shall: 2-18 (1) develop a plan to research pediatric diabetes and 2-19 medical conditions associated with diabetes in this state; 2-20 (2) assess the resources and talent of institutions in 2-21 this state as possible sites for research opportunities; 2-22 (3) analyze the impact of diabetes on the economy of 2-23 this state and on the health of the residents of this state; and 2-24 (4) make recommendations to the legislature and 2-25 governor concerning research programs in pediatric diabetes and 2-26 funding alternatives for the programs. 2-27 (f) The pediatric diabetes research advisory committee 3-1 shall meet at least four times as determined by the presiding 3-2 officer. A professional facilitator with experience in strategic 3-3 planning shall facilitate meetings of the committee. 3-4 (g) A member of the pediatric diabetes research advisory 3-5 committee may not receive compensation for service on the committee 3-6 but is entitled to reimbursement for reasonable and necessary 3-7 travel expenses incurred by the member while conducting the 3-8 business of the committee as provided by general law and the 3-9 General Appropriations Act. 3-10 (h) Not later than December 1, 2002, the commissioner of 3-11 public health shall submit a report prepared by the committee to 3-12 the governor, lieutenant governor, and speaker of the house of 3-13 representatives regarding pediatric diabetes that comprehensively 3-14 addresses the issues listed in Subsection (e) of this section. 3-15 SECTION 2. The commissioner of public health shall appoint 3-16 members to the pediatric diabetes research advisory committee not 3-17 later than the 90th day after the effective date of this Act. 3-18 SECTION 3. The pediatric diabetes research advisory 3-19 committee is abolished January 1, 2003. 3-20 SECTION 4. This Act expires September 1, 2003. 3-21 SECTION 5. This Act takes effect immediately if it receives 3-22 a vote of two-thirds of all the members elected to each house, as 3-23 provided by Section 39, Article III, Texas Constitution. If this 3-24 Act does not receive the vote necessary for immediate effect, this 3-25 Act takes effect September 1, 2001.
