A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the punishment for nonrestraint of a child in a motor
1-3 vehicle.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 545.412, Transportation Code, is amended
1-6 by amending Subsection (b) and adding Subsection (g) to read as
1-7 follows:
1-8 (b) Except as provided by Subsection (g), an [An] offense
1-9 under this section is a misdemeanor punishable by a fine of not
1-10 less than $25 or more than $50.
1-11 (g) An offense under Subsection (a) is punishable by a fine
1-12 not to exceed $10,000 if the offense results in serious bodily
1-13 injury to or death of a child.
1-14 SECTION 2. Section 545.413, Transportation Code, is amended
1-15 by amending Subsection (d) and adding Subsection (i) to read as
1-16 follows:
1-17 (d) Except as provided by Subsection (i), an [An] offense
1-18 under this section is a misdemeanor punishable by a fine of not
1-19 less than $25 or more than $50.
1-20 (i) An offense under Subsection (b) is punishable by a fine
1-21 not to exceed $10,000 if the offense results in serious bodily
1-22 injury to or death of a child.
1-23 SECTION 3. (a) The change in law made by this Act applies
1-24 only to an offense committed on or after the effective date of this
2-1 Act. For purposes of this section, an offense is committed before
2-2 the effective date of this Act if any element of the offense occurs
2-3 before that date.
2-4 (b) An offense committed before the effective date of this
2-5 Act is covered by the law in effect when the offense was committed,
2-6 and the former law is continued in effect for that purpose.
2-7 SECTION 4. This Act takes effect September 1, 2001.
